The case, which was referred to the police and health inspectorate by a number of women, has resulted in the police closing the criminal case and rejecting the victims’ complaints about the immunologist. Immunology is a subspecialty, which means that in order to obtain it, a doctor must first complete another residency. And if the doctor had a valid certificate from, for example, a urologist or gynecologist at the time of the manipulation, then the actions taken would probably have been more justified. However, the Health Inspectorate, although initially reluctant, later discovered that Nikiforenko had a valid laboratory doctor’s certificate until December 9, 1999. During the investigation of the case by the Health Inspectorate, the doctor himself was interviewed, who even admitted in his application that in one of his workplaces – in the clinic “Pulss 5” he had performed specific activities for sampling.

The doctor explained to the Health Inspectorate: “I consider it a mistake that additional analyzes were taken during the work at the Pulse 5 polyclinic. I will only send it to specialists in the future.”

Nikiforenko also admitted that in private practice he had used patient cards from his main place of work at that time – Pauls Stradiņš Clinical University Hospital. After evaluating five applications, the Health Inspectorate has indicated in its opinions that, according to the generally accepted practice in medicine, gynecological examinations in a specially equipped room are performed by a gynecologist and obstetrician, not by an immunologist. However, although the doctor himself does not deny that he has undergone gynecological examinations, they are not recorded in the patient records and is criticized by the Health Inspectorate.

And patients have also received answers from the inspectorate that it is not possible to assess possible sexual abuse, as it is up to law enforcement agencies to do so. Several patients have also turned there. Four were recognized as victims and two as witnesses.

The case was investigated for four years. It was started by one inspector, questioned by another and also recognized by the doctor as a suspect. He is required to stay in a certain place of residence and is prohibited from leaving the country. Then came the third inspector, who re-interviewed everyone involved. But the outcome was not what women expected.

Justine Savitska, author of the podcast, said: “At the end of 2013, the case goes to the same inspector who initiated the criminal proceedings. She receives instructions from the prosecutor’s office and closes the proceedings.”

And the broadcast is also looking for answers to why the criminal proceedings have ended. In short, the police have started working on a version of helplessness. The victims underwent a forensic psychiatric examination five years after the incident.

All opinions concluded that the emotional state during the visits could not be described as helpless due to the victim’s mental state.

What this means in criminal proceedings is that, as a state of helplessness has not been established, it is not one of the characteristics that must be present for a criminal to be found guilty.

At that time, the Latvian Medical Association also saw possible violations, but now the doctor himself does not want to talk about what happened to the authors of the broadcast.
