The bus to Kreischa was full. It always is at 5:40 a.m. The shift change in rehab is approaching and the nursing staff is on the way. That summer morning, however, it wasn’t just occupational therapists and physiotherapists, nurses and carers who were on their way to work. A couple also held on to the handles while standing. The bus driver was clearly driving too fast for the man. The 39-year-old Daniel G. describes the situation a few months later in the courtroom in Dippoldiswalde.

Here he sits as a defendant without a lawyer, pushes up his sleeves and leans his forearms on the table. He and his companion were thrown back and forth in the bus that early morning, and he complained about this to the bus driver. Suddenly he braked, which caused him to fly forward, and he saw his companion lying on the ground. Then he put his hand in the bus driver’s face to see whether that happened while driving or whether the bus had already stopped, he can no longer remember.

Penal order for bodily harm not accepted

In September he received a penalty order for bodily harm and was supposed to pay 40 daily rates of 20 euros, a total of 800 euros. He objects to this in due time. The matter is now to clarify the court, which has called five witnesses.

The public prosecutor asks the accused about the alcohol consumption the night before the bus ride: “My father died recently. We wanted to have a nice evening again. So we went to the gas station and had a drink there. We got to know really nice people there, ”says David G. The alcohol test later showed a blood alcohol level of 2.7.

Judge Christian Mansch explains that if he obstructed the bus driver while driving, a second criminal offense would be added: dangerous interference with the traffic regulations. The sentence from the penalty order would not be sufficient for this, in other words: it will not get away cheaper. The glass and building cleaner intelligently withdraws the objection, but now has to pay the court costs and the expenses of the witnesses.

The witnesses are released without being heard. When asked by the Sächsische Zeitung in front of the court, the bus driver remembers the morning. He drove normally and yet the man complained about his driving style. He smelled the man’s breath that he must have had a lot to drink. Suddenly the latter hit his lower jaw with his hand, whether with his fist or with the palm of his hand, he no longer knew. He was able to brake immediately, which caused the man to fly forward against the window, then got himself up again and hit him on the lower jaw a second time.

The offender was expelled from the bus, the police called

He then expelled the man from the bus and called the police. But they couldn’t find him at first and he would have continued his service for the time being. On the way back he saw the thug sitting in a bus stop, and the police, who were quickly called again, could now arrest him. A passenger who was also summoned as a witness confirmed the incident: “The bus was not particularly fast. I was amazed that the bus came to a straight stop when it braked without swinging to the right or left. ”The bus driver is not afraid after the incident:“ I’ve been driving the bus for ten years without any complaints. But something like that has never happened to me.
