Parked crookedly: parking tickets in Bremen’s supermarket parking lot – news from Bremen

Parking can be a problematic issue. Whether as a resident, commuter, supplier or as a guest in the city: Everyone who drives a car has to deal with the pitfalls that parking a car can bring. This is basically not new, but it is evidently always finding new varieties: Lidl customer Karin Stenzel claims to have received a ticket for 30 euros because she “did not park in the middle of the parking space”.

Not so long ago, readers of the WESER-KURIER approached the editors because they had been penalized with so-called contractual penalties in the parking lots of supermarket and fast-food restaurant chains: They had overlooked the then still new signs indicating that parking discs were mandatory. An instrument of private parking space management with which more and more retail companies want to ensure orderly conditions and space for customers on their parking areas. This attempt has now reached a new level of application.

Karin Stenzel assures that her vehicle was the only one in the wide area on the Lidl parking lot on Hemmstrasse in Findorff. You have not hindered anyone. “I had placed the parking disc visibly.” But the employee of Park and Control (PAC), who punished parking contract violations on behalf of Lidl, was unable to impress Karin Stenzel with her objections to the request for payment. “The parking disc requirement is indicated, but I saw no reference to the parking lot markings anywhere,” she pointed out. She also points out that the cascading effect can quickly occur in row parking spaces: All that is required is a car too wide for the marked area or parked at an angle, “then everyone will be outside the marked boundary”.

Paid grudgingly

The private ticket remained over 30 euros. “It’s pretty steep,” says Karin Stenzel. “In public space that would have cost five to ten euros,” she estimates – after speaking to a lawyer. He advised her to transfer the money: “I parked for two,” she admits, even if she hadn’t stolen a parking space from anyone, and paid grudgingly.

“Contract penalty? That is only possible if it is in the general terms and conditions and they are also displayed, ”says Nicole Mertgen-Sauer. The lawyer at the Bremen Consumer Center is familiar with the parking space issue. When parking management became fashionable a few years ago, it was more often associated with complaints. For a long time there was always something wrong with how openly and visibly the parking conditions were signposted on the parking areas.

The letter with which the Lidl press office in Neckarsulm responds to relevant inquiries still seems to come from this era and does not deal with “the new chargeable Fall”, as Karin Stenzel calls crooked parking.

“The processing fee of the external service provider can be up to 30 euros and is therefore adapted to public transport,” confirms Lidl and specifies: “This procedure relates to significantly exceeding the parking time.” There is no question of parking lot markings being run over.
