The parents of the killed Tamar (14) from Marken go to court. They demand that the perpetrator of the accident still be prosecuted. That is what the lawyer for the relatives, Sébas Diekstra, told ANP news agency.
Tamar walked out of the house on July 25, 2020, after a discussion with her parents about when she should go to bed. A few hours later, the police found her body on the verge of the Zeedijk between Marken and Monnickendam.
An investigation showed that a then 28-year-old German had run over her with his car. But the Public Prosecution Service (OM) declined to prosecute because the man could not have suspected that there was a collision.
The driver himself stated that he drove on because he thought he had hit a hole in the road. The Public Prosecution Service did impose a fine on the man for looking at his phone during the accident.
Tracks on the road
Independent accident expert Willem Baan Hofman recently concluded that Tamar must have been moved after the collision. He did so on the basis of traces he found on the road. The Public Prosecution Service also investigated that scenario, but points out that no DNA from the occupants of the car was found on the deceased girl.
The girl’s parents now want a judge to look into the case. Diekstra starts a so-called Article 12 procedure on their behalf, in which judges consider the decision of the Public Prosecution Service not to prosecute the suspect for leaving the scene of an accident.
