The parents of a baby born on Thursday in a clinic from the city of Mendoza They asked to postpone the vaccination and the court ordered that the inoculation is carried out and if necessary with the help of the public forcereported judicial sources.
Following this judicial decision, the parents declined their initial position and On Friday they accessed the vaccination schedule for their son.
The event occurred on Thursday at the Cuyo Clinic, located in the provincial capital, when the parents of the newborn refused to inoculate him, so Judge Rebeca Natalia Ropero had to intervene, who ordered that he should be vaccinated and if necessary with the use of public force.
Along with the Family Court, The Interdisciplinary Technical Team (ETI) also intervened to contain the family from the Mendoza town of Las Heras.
The justice system intervened to guarantee the inoculation of the newborn and that his right to health is not violated since they explained that the omission of it has consequences in the Contravention Code, in its article 119, of Law 9099, the sources indicated.
In the article mentioned in one of its points it states: “Parents, guardians, curators or guardians who omit their obligation to ensure that their children or minors in their care receive the mandatory vaccination included in the national calendar (Law No. 22,909), will be punished with a fine from two hundred (200) UF to eight hundred (800) UF or arrest of five (5) days or its equivalent in community work in public care centers or hospitals for minors.”.
In addition, it adds that “health providers (public or private) and any public agent or official who is aware of the violation of the right to vaccination of minors must communicate this circumstance to the local administrative authority; anyone who omits said communication will be sanctioned with double that provided for in the previous paragraph”.
