Parental leave, the allowance rises to 80% for two months. What changes in 2024

MILANO – It is strengthened from this year on parental leave, i.e. the optional leave that follows the mandatory maternity and paternity period. The Budget Law has in fact raised the allowance for two months to 80% of the salary, while for 2025 the second month the amount will drop to 60%. An application circular provides the details of the measure Inps.

Another seven months, in addition to the two above, are compensated at 30%, regardless of the income situation, as provided for by the law up to now. The remaining periods of parental leave, up to the limit of 10 or 11 months (if the working father exercises the right to abstain from work for a continuous or divided period of no less than three months) are not compensated, unless the parent concerned has an individual income less than 2.5 times the amount of the minimum pension paid by the compulsory general insurance. In the latter case they are eligible for compensation at 30% of their salary.

The increase in the amount

In the circular with which it gives instructions on the measure, the INPS explains that the increase in the allowance concerns exclusively employees while all other categories of self-employed workers, registered with separate management, etc. are excluded). The rule “does not add a further month of compensated parental leave, but provides for the increase of the allowance to 60% of the salary (80% for the year 2024 only) for a further month of the three due to each parent and not transferable to the other”.

The regulatory provision of the 2024 Budget Law concerns exclusively parents who end (even for just one day) their maternity leave or, alternatively, paternity leave after 31 December 2023. The terms

The month must be used within 6 months of the child’s age or upon entry into the family but in any case not after reaching the age of majority. The additional month compensated at 60% of the salary (80% for the year 2024 only) is only one for both parents and can be used split between them or by only one of them.

The remaining months

Subsequent periods of parental leave, to be taken within the child’s 12 years of age, are compensated at 30% of the salary, until the limit of 9 months is reached (including the month compensated at 80% and the month compensated at 60% , 80% for 2024 alone). Each parent is entitled to three compensable months (period not transferable to the other parent). Both parents are also entitled to a further indemnifiable period lasting a total of 3 months, which can also be used split between the parents, within the individual limits of the single parent and within the couple’s limit of 9 indemnifiable months.
