The chief justice of the Supreme Court of Justice of the Nation (SCJN), Norma Piña Hernández, “deserves impeachment” for inciting a work stoppage in the Federal Judicial Branch (PJF) and thereby committing various crimes, said this Sunday the federal deputy of Morena, Dolores Padierna Luna.
According to the legislator, the minister “is inciting senior officials and employees of the judiciary to strike by offering them pay without working in exchange for obstructing the legislative branch” in its attempt to approve judicial reform.
“We call on Minister Norma Piña to be rational, to respect the law, to adhere to the Political Constitution of the United Mexican States. Otherwise, she and any high-ranking official who is impeding the work of the Legislative Branch will be impeached,” Padierna warned in a statement.
In addition, the Morena member pointed out that the head of the PJF has incurred in various administrative responsibilities, conflict of interest and several crimes such as the illicit exercise of functions, abuse of authority, collusion of public servants, undue payment of remuneration and illicit use of powers.
In this regard, he cited Article 110, Section X of the Organic Law of the Judicial Branch of the Federation, which states that public servants are responsible for “failing to perform the functions of their senior positions.”
He also recalled that Title IV of the Federal Constitution establishes the responsibility of impeachment for ministers who break the law or commit crimes.
“The Supreme Court, as the head of the federal judiciary, is responsible for guaranteeing the provision of the public service of justice. Therefore, it is not allowed to strike because in its case it would be abdicating the powers conferred on it by the Constitution,” he said.
The 11 ministers, he pointed out, are not rank-and-file workers but rather those of trust, just like the high-ranking officials, judges, magistrates, secretaries of agreements, general directors of the PJF, among others, who by their position “are obliged to provide public service, in this case justice.”
“They do not have the right to strike, they cannot stop work, the rank-and-file workers can, but the top brass cannot, and Norma Piña is the president of the Judicial Council, in addition to being a minister of the Court; she should initiate administrative proceedings against those who are failing to fulfill their duties, but far from doing so, she herself orders the work stoppage and orders that these top brass be paid for not working, causing damage to the treasury,” he said.
