The court of Almelo sentenced Sebastiaan O. to 240 hours of community service and three months’ suspended prison sentence. The prosecutor’s service sought a seven-month prison sentence last month.
According to the judge, the 38-year-old Haaksbergen resident is responsible for the New Year’s Eve accident with a hammer. A 12-year-old boy was killed and an 11-year-old boy was seriously injured.
“There is an accumulation of errors and recklessness,” the judge said this afternoon, he reports RTV Ext. “Therefore, Bram’s death and Robbin’s serious injury can be attributed to O..” The judge specifically blamed him for jackhammering in broad daylight in the middle of a residential area, with many children as bystanders.
“O. never wanted to cause this drama, but he should and could have acted differently”, continued the judge, who therefore did not consider a prison sentence appropriate.

The man bought the device on Marktplaats from a private individual. The court wants to prosecute the seller for selling the folding hammer and the associated folding hammer powder.
