ORIAS: renewal 2023 – Insurance & Banking 2.0

Every year, before the 1is March, insurance, banking and finance intermediaries are legally required to renew their registration in the Register of insurance, banking and finance intermediaries (ORIAS) in order to be able to continue to exercise their regulated professional activities.

As a reminder, the 2023 renewal is marked by the implementation of law n° 2021-402 of April 8, 2021, known as “Brokerage reform”, which requires that insurance brokers and their agents, brokers in banking operations and payment services and their agents, barring express legal exceptions, belong to a professional association approved by the French Prudential Control and Resolution Authority (ACPR).

ORIAS notes that certain professionals are late in complying with this new requirement.

Aware of the issues relating to consumer protection and the economic risks that would be caused by the non-renewal of a large number of intermediaries following the closure of the renewal on February 28, 2023, the General Directorate of the Treasury and the ORIAS have agreed on the possibility of allowing an extension of the period during which intermediaries can renew their registrations with Orias in 2023.

This tolerance measure authorizes latecomers to submit their renewal requests to ORIAS until March 31, 2023.

After this time, no file will be accepted.

Orias will delete registrations whose 2023 renewal request has not been regularized, with effect from 7 April 2023.

This additional period does not exempt the intermediaries from all the legal obligations imposed on them: in particular the taking out of professional civil liability insurance and a financial guarantee, covering the period from March 1, 2023 until March 29, 2023. February 2024, for the intermediaries concerned.
