Order of November 13, 2024 extension of overseas adaptation SREN and DSA law

The essence of the order

Firstly, it makes applicable certain provisions of the European regulation of October 19, 2022 on digital services known as “DSA” which intends to make online platforms responsible for their moderation measures, in New Caledonia, French Polynesia, and the Wallis Islands. and Futuna, in Saint Pierre and Miquelon and Saint Barthélemy.

Secondly, it adapts and makes applicable to Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon and New Caledonia, French Polynesia and the Wallis and Futuna Islands, while respecting the sharing of skills between the State and these communities, the measures of the SREN law with the objective of:

  • protect minors from pornography by establishing a mandatory age verification system for access to sites reserved for adults;
  • strengthen sanctions against cyberstalkers or people who have committed serious offenses (child pornography, pimping) by introducing an additional penalty of digital ban;
  • defend the digital space against disinformation from foreign audiovisual media hit by European sanctions (type Russia Today or Sputnik) by directly conferring on Arcom the power to order Internet service providers, domain name providers and search engines to block access to the Internet addresses of these sites;
  • protect citizens from online fraud attempts by deploying an anti-scam filter against fraudulent SMS or emails.

The government has three months from the publication of the ordinance to submit a ratification bill to Parliament.
