Orban welcomed Poland, called on the EU to respect the sovereignty of the 27

The Polish Foreign Ministry has announced that it will still comply with European legislation

Hungarian Prime Minister Viktor Orbán has signed a government resolution welcoming the historic ruling of the Polish Constitutional Court. It disputes the superiority of European law over Polish law and accuses the EU institutions of exceeding its powers, the Associated Press reported.

The decision led the EU to an existential crisis and raised the possibility of Polexit (Poland’s exit from the EU).

The government resolution in Budapest called on the EU institutions to respect the sovereignty of the 27 member states, Orban’s spokesman Bertalan Havazi told the Hungarian Telegraph Agency.

Hungary’s position differs significantly from the joint statement by the French and German foreign ministries, which emphasized that Warsaw has both moral and legal obligations to comply with the EU’s common rules, which Poland joined in 2004.

Budapest emphasizes that the bad practices of the EU institutions, which disregard the principle of delegation of power, have led to the issue of the rule of national and European law being considered by the Polish Constitutional Court. “The rule of European law should apply only in areas where the EU has competence,” as stated in the European treaties, the Hungarian government said in a resolution. It also reminds that the EU institutions are obliged to respect the national identity of individual countries.

Poland’s foreign ministry, meanwhile, has said it will continue to comply with European law following a ruling by the Constitutional Court, Reuters reported.

The Foreign Ministry statement stressed that Poland respects international law. “All obligations arising from primary and secondary EU law remain in force and will therefore continue to be fully complied with in Poland.”

“The provisions of the EU Treaty set out in the judgment remain in force. What cannot be accepted are only the forms of their interpretation or application that violate the Constitution,” the Polish Foreign Ministry added.
