Open work permit for spouse
Spouses or common-law partners in Canada can apply for visas under the programs below:
- Spouses or common-law partners of skilled workers [C41] : Under this program, spouses or common-law partners of skilled workers who are working in Canada or who wish to come to the country can apply for an open work permit, even without having a job offer. Additionally, a dependent spouse or common-law partner may apply for an open work permit under LMIA exemption code C41 if the primary worker meets the following requirements:
- Holder of a work permit valid for 6 months
- Planning or physically living in Canada while working
- Employed in a job that falls under the National Occupational Classification (NOC)
- Spouses or common-law partners of full-time students [C42] : Full-time students can apply for an open work permit in Canada. Additionally, a dependent spouse or common-law partner may apply for an open work permit under LMIA exemption code C42 if the primary worker is a full-time student and holds a study permit at:
- A public post-secondary institution
- A private post-secondary institution
- A public or private secondary or post-secondary establishment
- A private institution of Canada that is authorized by provincial law

Requirements
- A bona fide relationship with spouse or partner: The applicant for the open spousal work permit must be in a bona fide relationship with or the spouse of a citizen, permanent resident or eligible foreign national.
- The principal applicant must have a valid work or study permit: The applicant’s spouse or common-law partner must hold a valid study or work permit in Canada.
- Criminal or medical inadmissibility to Canada: Neither the principal applicant nor their spouse/common-law partner is criminally or medically inadmissible to enter Canada.
