On Saturday, most of the provisions of the amendment to the Energy Law, the so-called the Counter Act. The new regulations are to start the gradual digitization of the energy sector – emphasizes the Energy Regulatory Office.
In the opinion of the regulator the amendment is a milestone in improving the transparency of the market operation, which in turn should contribute to improving its competitiveness. It also guarantees more efficient control and supervision of the energy market to the benefit of all its participants.
The most important changes introduced by the amendment include the installation of smart metering and remote reading meters, and the construction of a central energy market information system (CSIRE).
The new regulations assume that in the next seven years at least 80 percent. smart meters will be installed in Poland with remote reading of energy consumption.
As Rafał Gawin, the President of the Energy Regulatory Office, notes, market participants will gain broad access to data. This will allow, among others for faster and easier change of electricity supplier, which in turn will translate into the possibility of conscious management of energy consumption by end users.
Smart metering will also enable the introduction of new regulatory solutions, such as dynamic tariffs. It will also facilitate the monitoring of the quality of electricity in the power grid – it will be important for consumers, for example because of the effective pursuit of discounts for interruptions and improper quality of the supplied energy.

Data and information obtained from meters will be collected in the Central Energy Market Information System (CSIRE). The Energy Market Information Operator (OIRE) will be responsible for their processing and management of the system: this function will be performed by the transmission system operator, i.e. Polskie Sieci Elektroenergetyczne. On the other hand, the role of the ERO President will be to approve the principles of cooperation between OIRE and system users.
New recipes introduce and at the same time standardize the definition that appears in various acts energy storage, define the rules for connecting the storage to the grid and introduce favorable solutions for the accounting of energy storage. They also introduce a requirement to obtain a license for warehouses with a capacity above 10 MW.
The Act introduces the basis for the settlement of electricity introduced to the traction network during braking of trains or trams, the so-called recuperation.
The amendment also introduces a ban on concluding contracts for the sale of electricity and gas with off-premises household consumers. This solution was proposed, among others, by the President of the ERO, in connection with numerous cases of fraud and misleading recipients during direct sales in the so-called door-to-door formula.
