The National Commission, which carries out state regulation in the fields of energy and communal services, reports that on April 10, 2024, a meeting of the Commission took place in the form of an open hearing, at which the following decisions were made:
1. To issue licenses for the right to carry out business activities related to the supply of natural gas:
1) GAZ SUPPLY COMPANY KIF LLC;
2) TOV “UPE”.
2. To issue licenses for the right to carry out economic activities for the supply of electric energy to the consumer:
1) LLC “BAGATECH”;
2) “ENSO ENERGY COMPANY” LLC;
3) TOV “UPE”.
3. Refuse to issue licenses for the right to carry out business activities related to the supply of electric energy to the consumer:
1) LLC “EK CHEM-TRADE”;
2) CHEM-TRADE CO LLC.
4. Refuse the KP BMR “BCTM” to issue a license for the right to conduct economic activity in the production of electric energy.
5. To suspend the validity of the license for the right to carry out economic activities for the production of electric energy and for the production of thermal energy, issued by FIRM TEHNOVA LLC.
6. To suspend the validity of licenses for the right to carry out economic activity in the production of electric energy, issued by:
1) “KOMERTSBUDPLAST” LLC;
2) PAT “KVBZ”;
3) “STAR PIVDEN ENERGO” LLC.
7. Make changes to the resolution of the NCRECP dated January 4, 2023 No. 4 (name change).
8. To approve and publish on the official website, in order to receive comments and suggestions, a draft decision that has the characteristics of a regulatory act – the resolution of the NCRECP “On Amendments to the Licensing Conditions for Conducting Economic Activities in the Distribution of Electric Energy.”
9. To adopt the resolution of the NCRECP “On approval of changes to the Transmission System Development Plan for 2024-2033”.
10. To adopt the resolution of the NKREC on the approval of the Investment Program for the distribution of electric energy of JSC “KHARKIVOBLENERGO” for the year 2024.
11. To adopt the resolution of the NCRECP “On Amendments to the Resolution of the NCRECP dated January 10, 2024 No. 30” regarding the introduction of changes to the Investment Program of NEC “UKRENERGO” for 2024.
12. To adopt a resolution of the National Energy Regulatory Commission on approval of the schedule for the submission of investment programs by operators of electric energy transmission/distribution systems for consideration by the National Energy Regulatory Commission for 2025.
13. To approve the draft resolution of the NKREC on approving changes to the Investment Program of ZHYTOMYROBLENERGO JSC for 2024.
14. To postpone consideration of the issue of adoption of the resolution of the NCRECP “On Amendments to the Resolution of the NCRECP dated March 26, 2022 No. 352”.
15. To adopt the resolution of the NCRECP “On the settlement of certain issues regarding the submission of applications for setting tariffs, approval of investment programs (investment projects) and development plans in the field of centralized water supply and/or centralized water drainage for 2025.”
16. To adopt resolutions of the NCRECP regarding the approval of changes to the development plans for 2023-2027:
1) “BILOTSERKIVVODA” LLC;
2) KP CHERNIGIVVODOKANAL of CHERNIGIV CITY COUNCIL.
17. To adopt the resolutions of the NCRECP regarding the approval of changes to investment programs for 2023:
1) “BILOTSERKIVVODA” LLC;
2) KP CHERNIGIVVODOKANAL of CHERNIGIV CITY COUNCIL.
18. Approve the draft resolution of the NKRECP “On approval of changes to the Development Plan of the MUNICIPAL ENTERPRISE “PAVLOGRADSK PRODUCTION DEPARTMENT OF WATER AND SEWAGE MANAGEMENT” of the PAVLOGRAD CITY COUNCIL for 2023-2027 and to make changes to the resolution of the National Commission that carries out state regulation in the sphere of energy and communal services , dated July 18, 2023 No. 1314″.
19. Approve the draft resolution of the NKRECP “On Approval of Changes to the Investment Program of the MUNICIPAL ENTERPRISE “PAVLOGRADSK PRODUCTION DEPARTMENT OF WATER AND SEWERAGE MANAGEMENT” of the PAVLOGRAD CITY COUNCIL for the year 2023 and amend the resolution of the National Commission that carries out state regulation in the energy sector and communal services, from July 18, 2023 No. 1327″.
20. Approve and publish on the official website, in order to receive comments and suggestions, a draft decision that has the characteristics of a regulatory act – the resolution of the NCRECP “On Approval of Changes to the Code of the Transmission System” (regarding clarification of the provisions of the KSP related to the implementation of the ITS mechanism ).
21. To adopt the resolution of the NCRECP “On the results of the review of the dispute between JSC PRIKARPATTYAOBLENERGO and PJSC NEC UKRENERGO”.
22. To approve and publish on the official website, in order to receive comments and suggestions, a draft decision that has the characteristics of a regulatory act – the resolution of the NCRECP “On Approval of Amendments to the Code of Commercial Accounting of Electric Energy”.
23. Apply sanctions to “KIROVOGRADSKA OBLASNA EC” LLC for violation of the Licensing conditions for the supply of electric energy to the consumer and non-compliance with the requirements of legal acts regulating the operation of the electric energy market.
24. Apply sanctions to JSC “KYIVGAZ” for non-compliance with the requirements of legal acts regulating the functioning of the natural gas market, and violation of the Licensing conditions for carrying out business activities related to the distribution of natural gas.
25. To impose a fine on KP “IVANO-FRANKIVSKVODOEKOTEHPROM” for violating the requirements of the law and the Licensing conditions for conducting economic activities on centralized water supply and centralized water drainage.
26. Conduct an unscheduled on-site inspection of PRAAT “LVIVOBLENERGO” for the distribution of electric energy (verification of the reliability of data provided to the Regulator in reports or other documents).
27. Conduct an unscheduled on-site inspection of natural gas distribution LLC “GAS DISTRIBUTION NETWORKS OF UKRAINE” (Vinnytsia branch) (at the request of a representative of individuals).
28. Conduct an unscheduled on-site inspection of GAZOROZPODILNI MEREZHI UKRAINY LLC (Kyiv branch) for the distribution of natural gas (at the request of individuals).
29. Conduct an unscheduled on-site inspection of SE “KYIVGAZENERGY” for the supply of natural gas (at the request of individuals).
30. To conduct an unscheduled on-site inspection of Volyngaz ZBUT LLC (regarding the licensee’s compliance with the order of the NCRECP dated February 6, 2024 No. 32-r).
31. To increase the term of scheduled inspection of PJSC “LVIVOBLENERGO” for the distribution of electric energy.
32. To extend the term of scheduled inspection of “GRINTECO SES” LLC for the production of electric energy.
33. To increase the term of scheduled inspection of “MAYAK INVEST LTD” LLC for the supply of electric energy to the consumer.
34. To increase the term of scheduled inspection of Mayak Invest Ltd. for the production of thermal energy.
35. To increase the term of scheduled inspection of “EURO-RECONSTRUKTSIA” LLC for the production of thermal energy.
36. To extend the term of scheduled inspection of “EURO-RECONSTRUKTSIA” LLC for the production of electricity.
37. To increase the term of scheduled inspection of PJSC “TERNOPILGAZ” for the distribution of natural gas.
38. To adopt resolutions of the NCRECP:
“On establishing a “green” tariff LLC “STAROKOSTYANTYNIVSKY OIL EXTRACTION PLANT”;
“On Amendments to the Annex to the Resolution of the NCRECP of March 29, 2024 No. 621” (in terms of setting the “green” tariff of LLC “STAROKOSTYANTYNIVSKY OIL EXTRACTION PLANT” (Thermal power plant as part of the oil extraction plant (first stage) Khmelnytskyi region, (information with limited access )).
39. Approve Changes to the List of current accounts with a special mode of use of electricity suppliers, transmission system operator and market operator.
40. To approve and publish on the official website, with the aim of receiving comments and suggestions, a draft decision that has the characteristics of a regulatory act – the resolution of the NCRECP “On approval of changes to some resolutions of the NCRECP” (regarding the introduction of special auctions for auxiliary services).
According to the results of this meeting, the decisions of the National Commission, which carries out state regulation in the spheres of energy and communal services, will be formalized in resolutions and orders, published on the official website and in the “Information Bulletin of the NCRECP”, as well as placed in the Information and Legal Support System “League: Law ” and the Legal Information and Search System “Legislation”.
