Novel Baswedan and 74 other KPK employees complained to the KPK leadership regarding allegations of maladministration regarding the national insight test process (TWK) CCP. The results of the analysis of the report, Ombudsman RI stated that there were findings of maladministration in the national insight test (TWK) process at the KPK.
Initially, all KPK leaders were reported by Novel Baswedan et al Ombudsman the aftermath of the polemic of the KPK’s national insight test which did not pass 75 KPK employees in the assessment test to change the status of KPK employees to ASN. Director of Inter-Commission and Institutional Network Development (PJKAKI) Sujanarko – a representative of 75 KPK employees – said there were indications of maladministration related to the TWK process.
“Today, I represent 75 employees in making official reports related to the process TWK carried out by the CCP. Complaints are practically only signed by 15 employees who are TWK,” said Sujanarko at the RI Ombudsman office, Jalan HR Rasuna Said, Kuningan, South Jakarta, Wednesday (19/5/2021).
Sujanarko said there were six indications of maladministration by the KPK leadership. He said he would present the results of his further study.
“Later, we will convey the report to all of our friends. From our study there are many maladministrations that have been carried out by the KPK, both the issuance of the decree, the process, from the interview side there are almost 6 indications that we convey that the KPK leadership has committed maladministration,” he explained.
Chairman Ombudsman RI M Najih said he would follow up on the report. The report will be examined further.
“We will of course explore according to the procedures and authorities of the Ombudsman. Later we will take steps that we are most important about is how this process can be completed properly. Then Ombudsman RI has questioned the Deputy Chairperson of the KPK, Nurul Ghufron, regarding the alleged maladministration report. KPK conveys 3 related points TWK to the Ombudsman. The KPK emphasizes that it has legal standing or a legal basis for making KPK Perkom Number 1/2020.
First, Ghufron revealed that the transfer of the status of KPK employees was initially regulated in Article 1 point 6 of the KPK Law in conjunction with Article 3, and its implementing regulations regarding its duration were regulated in Article 69C of the KPK Law. Then it is regulated again technically in PP 41/2020. Then from PP 41/2020, it is regulated in more detail, technically it is regulated by the KPK with Perkom No. 1/2021.
“The basis for making a Perkom, Article 6 PP 41/2020. That is the basis of the KPK’s authority to regulate and then start from policies, regulations, carry out the transfer of the status of KPK employees to ASN,” said Ghufron.
Second, Ghufron also talked about procedures starting from the establishment of Commission Regulation No. 1 of 2020, the implementation of the transfer of the status of KPK employees which includes a national insight test to the implementation of the appointment of KPK employees to become ASN.
Third, Ghufron emphasized that all processes from policy making to the implementation of employee status transfers were carried out by taking into account the general principles of good governance. The indicator is transparent, the KPK claims that all KPK employees can read the draft Perkom. In addition, he said that the preparation of the KPK Perkom had also involved several related experts.
“When the Perkom is made, it is transparent. In what activities is transparency formed? Every Perkom at the KPK is always uploaded to the KPK on the KPK mailing list so that all parties at the KPK know the drafts of the Perkom,” said Ghufron.
After examining the CCP, Ombudsman also check other related parties. As a result, the Ombudsman found maladministration in the KPK TWK process.
