You could hear about Łukasz R. for the first time last fall, when he was arrested. The court then feared that, as a suspect, he might persuade other people to give false testimony. The impending high penalty also spoke in favor of pre-trial detention.
However, little was known about the case at the time. Today we know much more.
The watchman’s troubles began when, in his workplace, in Detention Center in Olsztyn, where he was a ward, he met inmate Robert. The men made friends.
Łukasz R. confided in his new colleague about his problems. He decided to help him from behind bars and instructed his friend from Dobre Miasto to let the guard in her company earn extra money as a taxi driver. Łukasz R. repaid him by handing over parcels outside of assignments, and also shared confidential professional information with other inmates. What’s more, according to witnesses, he was impressed by the criminal world and became fascinated by the environment of hooligans.
Everything broke when Robert began to suspect Łukasz R. of an affair with the above-mentioned friend. The gentlemen’s relationship was getting worse.
The guard was so determined that he proposed to Paweł, another inmate who was also one of the important hooligans, to murder Robert. He was to persuade him to do so many times. Both when Paweł was behind bars and when he was released. The latter, however, did not want to take on this task.
In recent months, Łukasz R. was dismissed from work in custody and charged with three crimes: repeatedly persuading Paweł to murder Robert, exceeding his powers (making extra money on a taxi without the consent of his superior and maintaining out-of-service contacts with convicted Robert), as well as giving unauthorized persons information.
The accused confessed to almost everything except incitement to murder. He claimed that he was only making such an offer in jest.
However, the court interpreted it differently. He sentenced Łukasz R. to a total penalty of five years of absolute imprisonment, a fine of 8,000 PLN and 10 thousand. PLN for the benefit of Robert.
– The lowest penalty for the offense of attempting to incite murder is at least eight years imprisonment – explains Olgierd Dąbrowski-Żegalski, spokesman for the District Court in Olsztyn. – However, in the opinion of the court, imposing such a punishment on the accused would be disproportionately severe, taking into account both the circumstances of the present case and his attitude. The court drew attention to the fact that Łukasz R. had not been in conflict with the law so far, and during the trial he expressed his sincere regret and apologized to the aggrieved party.
The verdict is not final. The parties may still appeal against it.
