CONSIDERING the file n. EX-2022-121444056- -APN-DAF#INT, the laws n. 25.164 and no. 27.591 of the general budget of the national administration for the year 2022, in force pursuant to art. 24.156 and their modifications, pursuant to the Decree of 23 December 2021 n. 882, Decrees 8 August 2002 n. 1421, 27 February 2006 n. 214, 3 December 2008 n. 30 June 2021 and 103 of 2 March 2022, resolution no. 53 of 22 March 2022 of the SECRETARIAT FOR PUBLIC MANAGEMENT AND EMPLOYMENT OF THE HEAD OF THE CABINET OF MINISTERS (RESOL-2022-53-APN-SGYEP#JGM) and resolution no. 775 of 20 May 2022 and its amendment no. 822 of 31 May 2022, e
CONSIDERING:
That with Decree 30 June 2021, n. 415 and its modification n. ) signed on 26 May 2021 between the Employer State and the Trade Union Sectors, with the third paragraph of which it was agreed to prepare a proposal for the Evaluation Regime of the Promotion by Evaluation and Merit for the personnel of the National Public Employment System included in the Collective Contract of Sector Work approved with Decree n. 2098 of 3 December 2008, by the State of the Employer having consulted the Trade Union Organizations within the Permanent Interpretation and Career Commission (Co.PIC).
That with the third paragraph of the Convention Act of 26 November 2021 of the Commission for the Negotiation of the Collective Labor Agreement of the SINEP Personnel Sector, approved with Decree no. 103/2022, it was decided to replace the wording of the third paragraph of the agreement of 26 May 2021 approved by decree no. 415/21 with the following “Only once and until 31 December 2023, permanent personnel included in this collective bargaining sector who meet the requirements for access to a higher Escalafonary Level and up to a maximum of two levels, can request the transfer by demonstrating their intention in writing, according to the evaluation regime for promotion by evaluation and merit established by the Employer State, after consultation with the Syndicate of Individuals within the Co.PIC. The Employer State can to order the change of Grade, by converting the position provided that the respective budget credits were available in each jurisdiction or decentralized bodies, depending on the case In all cases, those who had access to the most Tranches will be particularly valued high…”.
That, having prepared the proposed regulation pursuant to the aforementioned deed, the aforementioned Permanent Interpretation and Career Commission (Co.PIC), issued a favorable opinion with law February 11, 2022, n. 172 (cf. IF-2022 -16064393-APN-COPIC), which was approved with Resolution of the SECRETARY OF PUBLIC DIRECTION AND WORKING 53/2022.
That through article 2 of resolution no. 53/2022 of the SECRETARIAT FOR PUBLIC MANAGEMENT AND EMPLOYMENT OF THE HEAD OF THE CABINET OF MINISTERS (RESOL-2022-53-APN-SGYEP#JGM) the evaluation regime for promotion by evaluation and merit for the personnel of the National System for the Public Employment included in the Collective Labor Agreement of the sector approved with Legislative Decree 2098/2008, which it reviews on a permanent basis, which has stability at the time of expressing the will to participate in the aforementioned process and which is able to promote to the levels A, B, C, D and E of the aforementioned agreement.
That the unit responsible for the actions of the staff of the NATIONAL INSTITUTE OF THEATER has complied with the provisions of art. -CRRHO#INT.
That with Resolution no. 775 of 20 May 2022 and related amendment no. 822 of 31 May 2022, the process was started for the implementation of the Evaluation regime of promotions for evaluation and merit for the personnel of the National Public Employment System included in the Collective Sector Employment Contract approved with Legislative Decree 2098/2008, are the members of the Evaluation Commission were appointed and the Technical Administrative Secretary was appointed.
That the agent Alexandra GIUGOVAZ TROPPER, CUIL 27-29317835-1 of the permanent staff of this body, which is currently at Level D of the General Group Grade 5, General Tranche of the National System of Public Employment, applied pursuant to the Assessment for Promotion by Assessment and Merit to rise to Level C of the General Group of SINEP.
That in the advisability of signing the certification of compliance with the requirements and position identification form -FCCRH- the personnel actions unit considers that if the vertical promotion is approved, the worker must be appointed to the position of Control Assistant with orientation in the Supervision of Grants, Scholarships and Contributions for the Promotion of Theatrical Work of the Nomenclator of the Posts and Functions of the National Public Employment System.
That with Law n. 4 of 29 November 2022 (IF-2022-128726080-APN-CRRHHO#INT) the Evaluation Committee for Promotion by Evaluation and Merit of this body issued a favorable opinion regarding compliance with the requirements of the level and the group to which the agent Alexandra GIUGOVAZ TROPPER will apply.
That with NO-2022-133331900-APN-DAF#INT the head of the Financial Administration Service certified the existence of a budget credit in the current budget year to make the measure effective.
That, pursuant to the provisions of art. 31 of the Collective Contract for the Personnel Sector of the National Public Employment System, approved with Legislative Decree 2098/2008, the Unit in charge of personnel actions has determined that the classification must be assigned to worker 6 and General Section .
That the Legal Affairs Department of the NATIONAL INSTITUTE OF THEATER has taken the appropriate measures.
That this provision is issued under the powers established by Law no. 24,800, by art. 3 of the Decree of 22 May 2017 n. 355 and by Resolution no. HEAD OF CABINET OF MINISTERS (RESOL-2022-53-APN-SGYEP#JGM).

SOLVES:
ARTICLE 1.- Approval of the deeds of the Evaluation Commission for the Promotion for Evaluation and Merit formed by Resolution no. 775 of 20 May 2022 and its amendment no. 822 of 31 May 2022, relating to the request of the agent Alexandra GIUGOVAZ TROPPER, CUIL 27-29317835-1, who currently revises the permanent staff of the ISTITUTO NAZIONALE TEATRO in the position of Grade D of the General Group, 5th Grade, General Tranche of the National Public Employment System.
ARTICLE 2.- Agent Alexandra GIUGOVAZ TROPPER, CUIL 27-29317835-1 is appointed with the issuance of this provision, in accordance with the provisions of the Evaluation regime for promotion by evaluation and merit, approved in article 2 ° of resolution no. 53 of 22 March 2022 of the SECRETARIAT FOR PUBLIC DIRECTION AND EMPLOYMENT OF THE HEAD OF THE CABINET OF MINISTERS (RESOL-2022-53-APN-SGYEP#JGM), in a permanent position, Level C Grade 6, General Group, Tranche General of the NATIONAL SYSTEM OF PUBLIC EMPLOYMENT (SINEP) approved with Decree 3 December 2008 n. Control Department of the NATIONAL THEATER INSTITUTE.
ARTICLE 3.- The expenses necessary to comply with this provision will be covered by the specific items of competence 72 – MINISTRY OF CULTURE, Body 117 – NATIONAL THEATER INSTITUTE. Financial year 2022.
ARTICLE 4.- Communicate, publish, deliver to the NATIONAL DIRECTORATE OF THE OFFICIAL REGISTER and archive.
