Occupational safety and health: what ended during the summer

The end of the exceptional missions of occupational medicine

On 1 August 2022, the adjustments to the occupational health missions put in place to counter the spread of Covid-19 were completed.

These included information, prevention, screening and vaccination missions, but also the possibility for occupational doctors to issue work stoppages to employees infected or suspected of being infected with Covid-19 and certificates of isolation.

Disappearance of the partial childcare business

Until July 31, 2022, the partial activity could be applied to an employee forced to stop working to care for her child due to the health emergency (for example in the event of closure in the classroom or maternal assistant positive for Covid-19 ).

This device disappeared on August 1, 2022 and does not need to be reactivated. The Ministry of Labor confirms its disappearance in the questions and answers on the partial activity updated to 10 August.

Write it down

In case the child is sick, there are still solutions. If the child is affected by Covid-19, the employee can benefit, under certain conditions, from a work stoppage in derogation. Sick leave is also provided for other illnesses. This is unpaid leave. It is opened when a minor under the age of 16 for whom the employee is responsible is ill. Its duration is 3 days (5 days if the sick child is less than 1 year old or if his employee is responsible for at least 3 children under the age of 16). However, your collective agreement, contract or practice may include more favorable provisions such as compensation for days of absence.

The end of the emergency health regime and the crisis exit regime

The state of health emergency regime and that of managing the end of the health crisis (which provides for the use of the health pass) can no longer be mobilized from 1 August 2022.

Given the health situation, the Government did not consider it necessary to extend these measures.

Law n ° 2022-1089 of 30 July 2022 which puts an end to the exceptional regimes created to fight the epidemic linked to covid-19, Official Gazette of 31
