According to the theory of the case, Silva presented a mandatory conciliation request form in the Civil Court, which is the first step to start a lawsuit, with the apocryphal signature of De la Fuente. In that lawsuit, the lawyer planned to sue the OSP for an alleged debt of 80 million pesos.

She provided a pre-printed form which she filled in with her details and that of her sponsor. In it he claimed non-payment from July 2022 to October 2023 for various services rendered, as well as renovations and damage costs caused. However, a day later, he submitted a second document in which he requested that the above be rejected. That document bore an apocryphal signature from De la Fuente, they say.

After being requested by the civil judge, Garder’s representative appeared in court and together with a new lawyer, Paola Nale, said that the procedure that Silva had done was nothing, because it was not hers was the signature and took advantage of the opportunity to deny any representation on your part. For this reason, the magistrate immediately referred the case to the appropriate jurisdiction.

After analyzing the complaint, the Public Ministry realized that Silva’s behavior was within article 292 of the Penal Code, which refers to the falsification of a public instrument and provides for a penalty between 1 and 6 years in prison.
