Obligation to Report Discriminatory Incidents in Schools with Ethnic or Religious Background: 149 Cases in Baden-Württemberg

For years there has been an obligation to report discriminatory incidents in schools if they have an ethnic or religious background. Most in the area on the right.

Since 2018, there has been an obligation to report anti-Semitic and other religiously or ethnically based discriminatory incidents in public schools in Baden-Württemberg – so far 149 cases have been reported. Of these, 119 had a right-wing extremist background, according to a response from the Ministry of Culture to a request from two AfD MPs.

Five incidents had an Islamist background. Three incidents occurred in 2020 and were reported by vocational schools and a general secondary school. An incident from 2022 was reported by a special education and counseling center (SBBZ); There is an incident from a general secondary school from 2023.

The Ministry of Culture said there are no known attempts by Islamist-oriented actors to influence the political decision-making of the student body or staff at the country’s schools. There is an obligation to report if the incidents were at least punished with educational and regulatory measures or were still being punished at the time of reporting. In principle, Islamist incidents are also recorded, as these are regularly accompanied by discrimination against people of other faiths.

In four cases, the five events with an Islamist background had no specific addressee. One event concerned religious affiliation. There was no collection of personal data as part of the obligation to report anti-Semitic and other religiously or ethnically based incidents of discrimination by students in public schools. There are around 4,500 public schools in Baden-Württemberg.

Politically motivated crime is recorded on the basis of the criminal police reporting service. With the resolution of the Standing Conference of the Interior Ministers and Senators of the Federal States on May 10, 2001, the uniform nationwide criteria for defining and recording politically motivated crimes came into force retroactively to January 1, 2001.
