NY Implements Restrictions on Airbnb Short-Term Rentals, Considered a ‘De Facto’ Ban

In the city ​​of NYAs of today, a series of restrictions will begin to be applied to short-term rentals, which is considered by the tourist accommodation platform Airbnb as a “de facto” ban on their activity.

With the new regulations, all hosts are obliged to register with local authoritiesand also the rental of entire apartments is prohibited for less than 30 days when the owners are not present, something common in this type of business.

​In June, Airbnb sued the city and managed to delay the entry into force of the restrictions for a few months, since the regulations were planned to start applying on July 1.

Nevertheless, a judge dismissed the claim last month, considering that it is “rational” for the authorities to check the legality of the apartments they offer.

In a message through its website, the tourist accommodation platform regrets that its claim was dismissed, and reminds its hosts that as of today they have two options: register with the authorities or increase the time they offer their accommodation to more than 30 days.

In accordance with The New York Timesthe city estimates that some 10,000 Airbnb apartments in 2022 were fraudulent.

As in other cities in the world with great tourism, the authorities of NY explain that with this proliferation of tourist apartments, rental prices rise for permanent residents, which aggravates the housing crisis in the city.

Even after the announcement, the shares of Airbnb in the New York Stock Exchange they earned 7 percent, half an hour after opening.
