• The personnel that will go to the Agency are the people attached to the Directorate of Integral Air Management of the Undersecretary of Climate Change.
THE DECREE CREATING THE AIR QUALITY AGENCY OF NUEVO LEÓN, ESTABLISHES:
• FIRST.- The decentralized public body called the Nuevo León Air Quality Agency is created, with technical and management autonomy attached to the Secretary of the Environment of the State of Nuevo León, whose purpose is to carry out actions aimed at preventing , control and, where appropriate, avoid air pollution, as well as the monitoring of pollutants in the atmosphere and their corresponding registration.
• The Secretary of the Environment of the State of Nuevo León, will maintain at all times the original powers that, in the matter of emissions of pollutants into the atmosphere, are granted by the Environmental Law of the State of Nuevo León, its regulations, or any other provision. that is applicable for the due fulfillment of its powers, therefore, the person in charge of the Ministry of the Environment may, in any case, directly exercise the powers that are delegated by this Decree to the Agency that is created, or those that are delegated to it in the Internal Environmental Regulations.
• Article 4 of the Political Constitution of the United Mexican States, and article 44 of the Political Constitution of the Free and Sovereign State of Nuevo León, establishes that all people have the right to a healthy environment for their development and well-being, as well as as the duty to preserve it, being the State the one that guarantees respect for this right, also mentioning that environmental damage and deterioration will generate responsibility for whoever causes it.
