Beate Zschäpe has filed a constitutional complaint in Karlsruhe. The complaint was received on September 20, said a spokesman for the Federal Constitutional Court (BVerfG) on Friday, without giving details. Of the Spiegel had already reported on Thursday that her lawyers wanted to achieve that the Federal Court of Justice (BGH) decided again on the appeal of the 46-year-olds and this time had to negotiate orally beforehand.
In August, the BGH confirmed Zschäpe’s conviction as an accomplice in the racially motivated series of murders of the “National Socialist Underground” in a written decision. This leaves the penalty imposed by the Munich Higher Regional Court in 2018: life imprisonment if the guilt is particularly serious.
A spokesman for the BGH said that Zschäpe’s complaint was also pending there. Such a complaint to be heard asserts a violation of the right to be heard. Submitting them is a prerequisite for a constitutional complaint to be possible at all. The BGH spokesman said it would be decided on in a timely manner. Only then can the Constitutional Court continue.
According to Spiegel is the constitutional complaint signed by lawyers Mathias Grasel, Wolfgang Heer and Andreas Lickleder.
Zschäpe’s defender of choice, Grasel, said on request that the BGH’s rejection decision violated Zschäpe’s basic rights. “The BGH was not allowed to undertake this surprising expansion of complicity without holding a main hearing, so that here, among other things, the right to a fair hearing was violated.”
