Now the Lombardy Region no longer wants the coats donated by Fontana’s brother-in-law

The Lombardy region does not want more i 25 thousand gowns of the governor’s brother-in-law Attilio Fontana. Even if I am – even if they are free. The circumstance emerges from the correspondence between Aria, the regional purchasing center, and the Dama spa, the company of Andrea Dini and 10% of his sister Roberta, wife of the Pirellone tenant. The correspondence was filed in the acts by the defense of Dini, represented by the lawyer Giuseppe Iannaccone. Basically after getting the return of the gowns, kidnapped in July, Fontana’s brother-in-law wrote to Aria several times with the aim of donate the material: without success. The reason? The regional purchasing center is waiting for a response from the Milan prosecutor. But let’s go in order.

The story is well known: in recent months the pm Paolo Filippini, Luigi Furno e Carlo Scalas have entered in the register of suspects Fontana, accused of fraud in public supplies, Dini, the former CEO of Aria Filippo Bongiovanni, both also accused of disturbed freedom in the procedure for choosing the contractor, and an official of the regional company. It all begins on April 16, when Aria entrusts Dama with a supply from half a million euros for about 75,000 gowns. According to the indictment, when Fontana discovers “negotiation relationships“Between his brother-in-law and Aria – who place him in an evident conflict of interest -” personally asks “Dini to” renounce the payment to avoid controversy and exploitation “, to use the words spoken by the governor himself in the regional council. On May 20, the entrepreneur writes to the Region and transforms the coats supplied up to that moment – almost 50 thousand – into a donation, considering completed the supply. According to the prosecutor, however, that contract it has never been changed – despite the reply sent by Bongiovanni to Dini and the others summits of Aria also on May 20 – and for this reason the company of Fontana’s brother-in-law was obliged to send to the Region the others too 25,588 gowns.

Material that is kidnapped on July 28th. Returned to Dini on the first day of October, on the 17th of the same month Fontana’s brother-in-law wrote to Aria explaining that the prosecutor had released the gowns in order to put Dama back to the “obligations deriving from the supply order dated 16/4/2020“. And therefore, “while continuing to consider concluded the relationship resulting from the supply order in question “, Dini wants to deliver the coats to the Region” specifying that no amount will be charged not even for the transport costs of the aforementioned gowns “. The entrepreneur explains that he wants to donate those protective devices both “by reason of recent resurgence of the state of emergency and the worrying escalation of infections currently recorded in the regional territory “, but also because” with such immediate availability the Company feels the need to protect its image and reputation in relation to misrepresentation and the exploitation of the facts relating to the object “. Translated it means that even if Dini continues to consider the supply / donation of coats to the almost 50 thousand of last May, however, intends to give the remaining part to the region.

This letter, according to Fontana’s brother-in-law, “remained without confirmation”. For this reason, on 30 October the patron of Paul&Shark he writes again to the Region to ask if Aria intends or not “accept the aforementioned gowns“Taking into account” that the epidemiological emergency is raging “. At this point Aria responds. President Francesco Ferri he explains that even if it is “true it is that there would be actual utility, in the current emergency situation, to acquire the gowns covered by your note “, it is however necessary” to proceed with the formalization acceptance of the donation, and this inevitably requires clarification about the correct legal title to recognize your offer “. For this reason Aria “believes essential, for purposes precautionary, acquire every useful element in this regard, too compelling, to the extent permitted, the Public Prosecutor’s Office at the Court of Milan “. In short: the purchasing center of the Region, involved in the investigation with the former CEO Bongiovanni, wants to avoid making any movement without the green light of the prosecutor. Position reaffirmed again on November 17, to respond to the third letter from Dini asking for a follow-up to his donation proposal formulated “for 22 days now, inexplicably no match“.

“To date, the aforementioned Public Prosecutor’s Office has not yet responded to the request, and this is the reason why no updates have been provided”, is the justification of the regional purchasing center, which accuses Dama of being in contradiction because “first assumes that the original supply should be considered concluded and then highlights that the release from seizure would be finalized also to allow Dama to fulfill the obligations deriving from the supply order dated 16/4/2020 ″. A contradiction that for Dini does not exist, given that he explained of want to donate the gowns despite the fact that he continues not to “agree with what was mentioned in the aforementioned decree, namely that the supply in question would still be in existence”. In any case, the entrepreneur writes again, the “different interpretative perspective between the Milan public prosecutor’s office and the Dama company is completely irrelevant to the present affair”. Which has been going on for some time now. “The first letter with which Andrea Dini expressed his desire to donate another 25,000 gowns to Aria dates back to mid-October. A month and a half has passed and we have not yet received a clear answer. At this point, we’ll give Aria a deadline to accept or reject the gowns, ”says the lawyer Iannaccone, lawyer of the entrepreneur. “If this silence should continue or if further inconclusive answers follow one another, there we will donate to those who need it – he continues – I read just yesterday about several hospitals in difficulty, especially in Southern Italy, where Dpi devices are a rare commodity. I think 25,000 gowns would be handy there. Apparently, Aria no longer needs them“. Sources of the prosecution, for their part, let it be known that after the release from seizure the suspect is “master“Gowns: in short, he can use them as he sees fit. Meanwhile, those 25,000 protective devices are still in stock.
