Note on sale in stores. UOKiK is preparing changes to commercial law

Prepared legal changes implementing the so-called the omnibus directive is to eliminate situations in which sellers artificially inflate the prices of goods or services just before applying the reductions, in order to encourage us to buy with an allegedly high discount later – explained the President of UOKiK Tomasz Chróstny, quoted in the message.

UOKiK is preparing changes to the law

According to the project published on the website of the Government Legislation Center, sellers will be required to inform about the price before the discount. This will apply to both products and services.

– The solution included in the bill assumes that the entrepreneur is obliged to inform consumers about the lowest price of a given product in the last 30 days. It will not be possible to use the mechanism of artificially raising prices a week or two before the sales in order to later boast about price reductions, and the consumer will know the real scale of the reduction – explained the President of UOKiK

Penalties for unreliable sellers

If entrepreneur informs about prices unreliably, the Trade Inspection may apply sanctions up to 20,000 PLN, and in the case of repeated irregularities up to 40,000. zloty. If, on the other hand, the scale of the phenomenon is widespread and the collective interests of consumers are infringed, the president of UOKiK may impose a sanction of up to 10%. the entrepreneur’s annual turnover.

As UOKiK reminded, consumers buying at sales in other countries European Union have the same rights as in Poland. In some EU countries it is the law that sets the maximum duration of a sale – for example in France or Luxembourg it is one month during each summer and winter season, and in Portugal it is four months a year. During the sale, the European Consumer Center Poland notes consumer reports concerning, inter alia, the problem with replacing a defective product, especially when it was bought at an extremely bargain price. Sellers prefer to return the money rather than deliver a new item that is already available at the regular price.
