During his interview, he stated that he had calculated the commission for an upcoming customer appointment. Until the decision of the Federal Court of Justice, it was unclear whether a pocket calculator should be evaluated like a cell phone and whether its use by a vehicle driver was generally prohibited in accordance with Section 23 (1) a of the StVO. “

Haufs-Brusberg continues: Until the road traffic regulations were changed in 2017, only the use of cell phones and car phones while driving was expressly prohibited, before the ban was extended to other electronic devices. Since this change, navigation devices, for example, may only be used if the driver no longer has to pick them up or if voice control is available or if a quick glance at the screen is sufficient.

The aforementioned real estate agent was not only on the road with a calculator at the wheel, but also too fast and was therefore fined i by the Lippstadt district court in Westphalia. H. v. € 147.50 was fined. According to the appellate authority, this decision was taken by the Federal Court of Justice.
