The court has stopped the case between the airline Norwegian and the state regarding a climate fee of NOK 400 million. The EFTA court is now connected.
Norwegian has sued the state to avoid a climate fee of NOK 400 million. It is now clear that the case will go to the EFTA court, which Norwegian did not want. The company has previously argued that it would be “very unreasonable”, writes E24.
The airline confirms that the legal costs will increase somewhat as a result of the EFTA process. Whether it is the state or Norwegian that will foot the bill will become clear when a judgment is handed down.
– We have no comments on the case now, says communications director Esben Tuman to E24.
The case has been halted until the EFTA Court’s advisory opinion is issued, according to a ruling by the Oslo District Court dated 4 October this year.
The legal question the EFTA court must decide on is whether a company that is undergoing a reconstruction must fully deliver climate quotas. It is unknown when the Efta court’s decision will come, and what the process will cost.
