And above all, at the starting regulatory distances since one of the objectives of these charters, declined in other departments, resided in particular in the possibility of lowering these “non-treatment zones” to three meters for viticulture and other crops. , and five meters for arboriculture.

According to the government decree published in December 2019, the distances to be respected between the treatment areas using phytosanitary products and the residential areas are as follows: for the substances of the most concern, 20 meters incompressible, for the other products ; 10 meters for arboriculture, viticulture, 5 meters for other crops. Since the invalidation of the charters by the Constitutional Council, it is again these distances that come into force.

“These distances are still insufficient for us, but it is a positive point”, reacts Sylvie Beltrami, co-president of the Association for the defense of the environment and nature in the Yonne. Like other environmental associations solicited, Adeny had, at the time of the consultation, considered the drafting of the charter too hasty. “We strongly hoped for this outcome, failing to have had a major consultation”, continues the co-president. Which also underlines the role played by the Environmental Charter in the decision-making of the Constitutional Council.

“Things must be done right”

For the president of the chamber of agriculture, Arnaud Delestre, it is on “a flaw more than on the substance” that the judgment of the Institution was made. “The context was not dreamed of, that’s for sure, but these charters had to be put in place fairly quickly.”

While the cultivation campaign has already started, “we are awaiting a return to the national level to know how to bounce back following this decision”, continues Arnaud Delestre.
