No test date? No lawsuit possible – economy and work

Thousands of unvaccinated workers risk not being able to work after October 15th because there are not enough test facilities. This problem was not foreseeable by the legislature, says lawyer Burkard Zozin. Those affected are on their own.

No test date? No legal action

If a non-vaccinated employee does not manage to get tested in time to start work because he does not get a test date, he has no legal recourse, says lawyer Burkard Zozin. The law does not provide for any regulation here.

“This employee is then unjustifiably absent, receives no wages. He cannot sue the employer because the employer adheres exactly to the law. And if the employee then wants to sue the state or whoever, he must prove that in full South Tyrol has been for him and that is very difficult, I think. Conclusion from my point of view: Better to get vaccinated, then you don’t have all these problems. “

It is estimated that around 50,000 unvaccinated workers will need a valid corona test from mid-October in order to be able to work. The 80 pharmacies in the country that run tests currently only manage 8,000 to 10,000 tests a day together.

According to Governor Arno Kompatscher, work is being carried out on capillary test capacities in the communities. Community association president Andreas Schatzer promises to reopen the test centers in the communities.
