The Supreme Court (MA) decided to reduce the sentence of a former FPI figure Rizieq Shihab from 4 years in prison to 2 years in prison for spreading fake news about the results of a swab test at Ummi Hospital.
The decision to reduce the prison term was announced by the chairman of the cassation panel, Suhadi, together with members Suharto and Soesilo, on Monday (15/11) afternoon.
“Improved the decision of the DKI Jakarta High Court Number 210/Pid.Sus/2021/PT DKI which changed the decision of the East Jakarta District Court Number 225/Pid.Sus/2021/PN Jkt. Tmr regarding the sentence imposed on the defendant to a prison sentence of two years,” quoted from the verdict received from MA Spokesperson Andi Samsan Nganro, Monday (15/11).
In its consideration, the panel considered that the defendant was indeed proven to have deliberately broadcast false notices. However, the impact is only in the mass media.
“Although the Defendant has been proven to have committed an act by publishing a false notice deliberately publishing a riot among the people as in the Public Prosecutor’s First Alternative Indictment,” according to the Council of Judges.
“However, as a result of the publication of the disturbances from the Defendant’s actions only occurred at the level of the mass media, there were no casualties/physical or property losses,” continued the Judge.
In addition, Judge Rizieq has already been convicted in another case which is a series related to the Covid-19 case.
“As well as against the Defendant apart from in the a quo case, he has also been convicted in other cases which are a series of events involving Covid-19,” explained the Judge.
“Therefore, Judex Facti’s sentence to the defendant for 4 years is considered too heavy. So that the sentence imposed on them is worthy or justified to be corrected by imposing a lighter sentence,” said the verdict.
As is known, the East Jakarta District Court previously sentenced Habib Rizieq Shihab (HRS) to 4 years in prison. The East Jakarta District Court declared Rizieq guilty of violating Article 14 paragraph (1) of the Republic of Indonesia Law Number 1 of 1946 concerning the Criminal Code in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
