Nice Administrative Court Annuls Decree Regulating Accommodation on Online Platforms

Nice town hall has just suffered a major setback in its crusade against furnished tourist rentals. This Wednesday, January 31, the administrative court annulled a municipal decree toughening the rules governing the provision of accommodation on platforms such as Airbnb.

Since 2022, the text has required owners wishing to change the use of their accommodation to prove that this was authorized in the co-ownership regulations.

“This element has allowed the city of Nice to considerably reduce the number of authorizations, almost 70% of requests having been refused,” boasts the town hall, the second city in France in terms of advertisements on the Internet, i.e. 12,600 in 2022. .

In a press release issued by the municipality, the city is angry with the decision of the administrative court of Nice, Christian Estrosi deeming it “incomprehensible”.

“We will never let go”

The mayor of Nice does not deny that “seasonal rental platforms are major economic players in addition to hotels and contribute to the development of businesses and the revitalization of the economy”, but he considers it essential “to preserve the interest of inhabitants and the tourist balance.

Christian Estrosi is all the more surprised that the deputies voted on Monday January 29, at first reading, a text attacking the tax loophole for furnished tourist accommodation, and “while our country is facing a housing crisis”.

The municipality intends “not to let this unjustifiable decision pass” and announces its intention to appeal. “We are preparing a decision for the next municipal council which will regulate seasonal rentals even more strongly,” warns Christian Estrosi.

His first deputy, Anthony Borré, hit the nail on the head on X (ex-Twitter): “We will not give up and will go even further!”

This municipal decree was added to a body of regulations, a text of which provides for removing street furniture from boxes containing keys to seasonal rentals. Other French cities, such as Paris and Marseille, have raised their voices in recent years to demand better supervision of Airbnbs.
