New York’s Strict Short-Term Rental Law Shakes up Airbnb and Other Platforms

Thousands of Airbnbs and short-term rentals are in the process of being wiped off the map in New York.

Local Law 18, which took effect Tuesday, is so strict that it not only limits Airbnb rentals in the city, it almost completely bans them for many hosts. Now, all short-term rental hosts in New York must register with the city, and only those who live in their accommodation regularly (and who check in when a guest stays there) can stay on the property. walk. Gone are the days of elegant apartments designed for hen parties, comfortable two or three bedroom penthouses close to museums for families, and even the possibility of renting out your property for a weekend. Airbnb, Vrbo and other platforms can continue to operate in New York, but the new rules are so strict that Airbnb considers them a “de facto ban” on its business.

Short-term rentals bring with them their fair share of noise, dirt and danger, and can also disrupt locals in their own neighborhood. Some New York landlords own numerous properties and post hundreds of listings on Airbnb. Other residents, also present on Airbnb, try to make ends meet, either by renting their accommodation during their absences, or by providing half of a duplex to help them cover their mortgage.

Airbnb is popular with 66 million visitors who, each year, look for accommodation that is cheaper and sometimes larger than hotel rooms. In 2022 alone, short-term rentals in New York brought in $85 million. Although the city represents only a small share of Airbnb’s global market, these new rules show how local governments can quickly and effectively combat short-term rentals and reduce their impact on high-density residential areas. Card Limits

Each takes its own approach. Dallas has limited short-term rentals to specific neighborhoods, to no longer host parties that could disrupt the neighborhood or even be dangerous. Memphis, Tennessee, and the Canadian province of Quebec now require licenses for short-term rentals. In San Francisco, it is illegal to rent your entire residence on Airbnb for more than 90 days per year; Amsterdam sets this limit at 30 nights per year and Paris at 120 days. For its part, the city of Berlin had previously banned almost all Airbnbs, but reversed its decision in 2018.

To date, Airbnb’s attempts to fight the new law have proven unsuccessful. The platform sued New York City in June, but the judge dismissed the suit in August, ruling that the restrictions were “inherently rational.” The complainant has not indicated whether he will appeal the decision. Hosts are also fighting to be able to rent their apartments on a short-term basis and are holding more meetings with municipal officials, in the hope of changing the law.
