On February 15, the legalization of surrogacy will come into force in New York, as well as the new associated insurance protections. These provisions are part of the budget promulgated by Governor Andrew Cuomo for the 2021 fiscal year (cf. New York State allows surrogacy during a COVID-19 budget). These “Protections and rights” include:
- Life insurance for surrogate mothers, at the expense of the intended parents,
- Health insurance, also payable by the intended parents, “Which must cover maternity care benefits, preventive care and screening related to pregnancy”,
- Insurance for intended parents, “Which covers their financial losses if the surrogate mother does not fulfill her obligations under the surrogacy contract”,
- Intended parents can also purchase insurance for medical costs associated with donating gametes.
The governor reminded New Yorkers yesterday that Surrogacy is a “Major priority” for the Council on Women & Girls from New York. These measures aim to guarantee “Peace of mind during the family planning process”, according to Melissa DeRosa, its president.
Nothing is provided, however, to protect against abandonment or abortion, “Common practices in the surrogacy industry” and “Which we know are harmful to children”.
