Sales in New York: what does the law say?
In the United States, there is no federal law governing sales and promotions. However, each state has its own legislation in this regard.
In New York, the sale law is known as the “Fair Retail Practices Act”. This law states that merchants have an obligation to sell items at their lowest price within 90 days of the sale, unless they are sold at a loss.
The law also stipulates that sale prices must be clearly displayed, that sale items must be available in sufficient quantities, and that items sold at a reduced price must be of the same quality as items sold at full price.
It is important to note that New York clearance sale law only applies to physical merchants. Online sellers are not subject to the same rules, although the Federal Trade Commission has enacted similar rules for e-commerce sites.
