New York Pays Million-Dollar Settlement in Hijab Lawsuit


The state of New York will pay the million-dollar amount to resolve a class action lawsuit initiated in 2018 by two women. Both accuse the police of forcing them to remove their hijab during their arrest.

In 2018, two women filed a lawsuit against the police of NY where they were accused of having forced them to remove their hijab to be photographed during their detention. Now, the city must pay US$17.5 million in damages and losses.

Subtracting administrative expenses and attorneys’ fees, the final compensation is about US$13 millionwhich will be distributed among those people who present claims similar to those of the plaintiffs, identified as Jamilla Clark and Arwa Aziz.

The plaintiffs claimed to feel “naked” after removing their religious veil.

According to EFE, the agreement still requires the approval of a judge from the Southern District of NY. However, both parties established that those who were forced to remove their hijab between the March 16, 2014 and August 23, 2021may demand compensation of at least u$s 7.824.

In the lawsuit, Clark and Aziz reported that in 2017 they were taken to a police station where they were forced to remove their religious veil. Both assured that they felt “naked“and they suffered traumas and anguish knowing that the photos in which they appear without their hijab can be seen by anyone who has access to them.

The case that changed NYPD policy

Due to the relevance that the collective lawsuit of Muslim women took on, The NYPD changed its policy in 2020 so that detained people can have veils or other religious clothing to take a photo.

However, this was not the first case in which Muslim women claimed that they were forced to remove their hijab, as during the year in which Clark and Aziz’s lawsuit took place, three women were compensated with and $s60.000 in separate cases for the same reason.
