“New York Implements Law Requiring Rental Unit Owners to Disclose Flood-Prone Location and Past Damage”

Starting June 21, rental unit owners must provide information indicating whether their properties are located in a flood-prone area.

They must also specify if said property has been affected in the past by floods.

And this as part of a law enacted by Governor Kathy Hochul last year, which seeks to provide tenants with more transparency before signing a rental agreement.

The disclosure law could be of particular importance in New York City, where about two-thirds of rental housing and new construction sits in flood-prone areas.

In this way, New York joins states such as California, Oklahoma, Georgia, New Jersey, Indiana, Oregon and Texas, where it is required to disclose to potential renters about the possibilities of flooding.
