NEW YORK — All businesses in New York City will be required to place waste in a sealed-lid trash can starting March 1, the day this new law goes into effect. The rule applies to all companies that deposit waste at the curb, but not to businesses that have waste collection at a loading dock.
The rule is part of the New York City Department of Sanitation’s (DSNY) commitment to keeping streets clean and reducing the number of black bags lining the city’s streets, a process that began in April 2023, when they changed waste disposal times for residents and businesses by reducing the time trash, recycling and curbside composting will remain on sidewalks.
Here we answer some questions.
WHO MUST COMPLY WITH THE STANDARD
All food-related businesses are affected, and all businesses with five or more locations in New York City, regardless of what is sold.
This includes catering, food manufacturing, food service and food preparation companies, food wholesalers, and food retail stores. It also includes businesses under the same name, under common ownership, or businesses under a franchise agreement with the same franchisor. NOTE: Restaurants, grocery stores, delis, wineries, catering companies, and other businesses that sell or handle food must comply.
Starting March 1, 2024, ALL businesses of any size MUST place waste in a container with a secure lid. This applies to ALL businesses that place waste at the curb. This does not apply to businesses that have waste collection at a loading dock.
WHAT TYPES OF WASTE?
All trash, food, and food-contaminated paper must be in a container with a secure lid when placed curbside for collection. The requirement does not apply to recyclable materials (metal, glass, plastic, or clean paper and cardboard).
This rule does not require the separation of trash from food or food-contaminated paper; it only requires that these materials be placed in containers with secure lids for collection.
NOTE: Companies required to separate organic waste under the Ley Local 146 of 2013 should continue to do so by placing their food waste in a separate container with a secure lid.
