New York City further tightens the law governing rentals of Airbnb apartments

Rules for renting an apartment in New York

Do you want to rent an apartment in New York for your holidays? Pay attention to the regulations in force in New York! Contrary to what is practiced in other parts of the world, the city of New York imposes very specific rules, as I explain in my article on rules for renting an Airbnb apartment in New York. Renting an apartment in New York through Airbnb or any other platform is only possible if you meet one of the following 3 conditions:

• 1/ The rental period must be longer than 30 days. Suffice it to say that this condition does not apply to tourists who come to New York for a week or two…
• 2/ Or the rental is in a building with less than 3 apartments, which in other words means 2 apartments… A condition that is impossible to meet in Manhattan.
• 3/ Or the owner of the apartment is present in the apartment for the entire duration of the stay. This is therefore equivalent to renting a room with locals and no longer has much to do with renting an apartment as we usually understand it.

All other cases are therefore considered illegal rentals. and the NYPD, which enforces City Hall regulations, will then have the ability to initiate proceedings against the landlord. What will change from January 2023

And it doesn’t end there! New York City Hall just announced a tightening of the measures effective January 9, 2023. Here are the 3 additional rules that are added to the device:

• Landlords will first need to provide proof that the rental apartment is their permanent residence. This excludes many offers presented by landlords who rent an apartment in which they do not live. Violations face a $5,000 fine.
• Rental platforms, including Airbnb, will also need to verify that the owners actually live in the rental apartment. In case of non-compliance, a fine of $1500 will be sent to the platforms for each invalid ad.
• Finally, the owners will be obliged to provide a floor plan of their accommodation and will be prohibited from reserving a particular room with separate access for tourists. Tourists must have access to all rooms of the rental apartment and enter through the main entrance of the apartment.

The new rules will be subject to strengthened controls, through the Office on Special Enforcement, which reports directly to the mayor of New York.
