New York City further tightens law governing Airbnb apartment rentals – CNEWYORK

Rules for renting an apartment in New York

Would you like to rent an apartment in New York for your holidays? Pay attention to the regulations in force in New York! Contrary to what is practiced elsewhere in the world, the city of New York imposes very specific rules, as I explain in my article on the rules to respect to rent an Airbnb apartment in New York. Renting an apartment in New York via Airbnb or any other platform is only possible if you meet one of the following 3 conditions:

  • 1/ The duration of your rental must be more than 30 days. Suffice to say that this condition does not apply to tourists who come to New York for one to two weeks…
  • 2/ Or the rental is in a building with less than 3 apartments, which in other words means 2 apartments… A condition that is impossible to meet in Manhattan.
  • 3/ Or the owner of the apartment is present in the apartment for the entire duration of your stay. This therefore amounts to renting a room with the locals and no longer has much to do with renting an apartment as we usually understand it.

All other cases are therefore considered illegal rentals. and the New York police, which applies the regulations enacted by the town hall, will therefore have the possibility of initiating proceedings against the owner. On our groupe Facebook Destination New Yorkyou will find several examples of tourists having to find a hotel at the last minute, at a high price, when their rental was finally cancelled.

What will change from January 2023

And it doesn’t stop there! New York City Hall has just announced a strengthening of measures starting January 9, 2023. Here are the 3 additional rules that are added to the device:

  • Landlords will first need to provide proof that the rented apartment is their permanent residence. What exclude many offers submitted by owners who rent an apartment in which they do not live. A $5,000 fine is provided for violations.
  • Rental platforms, including Airbnb, will also have to verify that the owners do indeed live in the apartment being rented. In case of default, a fine of $1500 will be sent to the platforms for each invalid ad.
  • Finally, the owners will have the obligation to provide a plan of their accommodation and they will be prohibited from reserving a particular room with separate access for tourists. Tourists must have access to all rooms of the rented apartment and enter through the main entrance of the apartment.

The new rules will be subject to reinforced controls, via the Office on Special Enforcement, which depends directly on the mayor of New York.
