New Work Stoppage Laws: Changes in Daily Allowances, Miscarriage Leave, and Teleconsultation Prescriptions

Daily allowances: the waiting period is waived in the event of miscarriage

Since January 1, 2024, you can benefit from a sick leave without delay in deficiency if you are the victim of a miscarriage. And this, whatever your professional status: employee, civil servant, self-employed, or self-employed agricultural worker.

In detail, you will be compensated by health insurance from the 1st day of your work stoppage if you undergo a miscarriage (spontaneous pregnancy interruption) before the end of the 22nd week of amenorrhea. In practice, your doctor will give you a specific paper form entitled “initial work stoppage notice without deficiency”. You will only have to send it to your local CPAM to benefit from your daily allowances.

This modification comes from the law of July 7, 2023 aimed at promoting the psychological support of women victims of miscarriage.

It should be noted that if you are an employee, the text establishes the prohibition for your employer to dismiss you within 10 weeks of miscarriage, except in the event of serious fault or impossibility of maintaining the employment contract.

TO NOTE

Things should also evolve in terms of medical termination of pregnancy (IMG). At the latest on July 1, 2024, the daily social security allowances will be paid without waiting period to women who have undergone an IMG.

Work stoppages prescribed by teleconsultation now limited to 3 days

Please note: since the beginning of the year, you can no longer prescribe a sick leave of more than three days by teleconsultation !

However, there are some exceptions to this new principle:

  • The duration is not limited when work stoppage has been prescribed or renewed for you by your treating doctor;
  • Nor when you were unable to consult a doctor to obtain, by a prescription carried out in his presence, an extension of your work stoppage. In this case, you will need to provide justification.

Employees, self-employed: the maximum amount of your illness IJ is increased in 2024

Remember: on September 13, 2023, the Court of Cassation judged that employees had to acquire paid holidays when they were on work stoppages.
