New Ukrainian Citizenship Law: Proposals to Deprive Citizens of Citizenship and Introduction of Multiple Citizenship

Citizens of Ukraine are proposed to be deprived of citizenship in the event voluntary acquisition of citizenship of a state recognized by the Verkhovna Rada as an aggressor state or an occupier state or nationality of the nationality of another state that is not defined as a state.

Voluntary acquisition of citizenship of another state is considered to be all cases where a citizen of Ukraine, in order to acquire citizenship, had to submit an application or petition for such acquisition in accordance with the procedure established by the national legislation of that state.

Except for the case, it is provided for by part six of Article 5 of the Law of Ukraine “On ensuring the rights and freedoms of citizens and the legal regime in the temporarily occupied territory of Ukraine.”

The following are not considered voluntary acquisition of another citizenship:

  • simultaneous acquisition by a child by birth of citizenship of Ukraine and citizenship of another state or states;
  • acquisition by a child who is a citizen of Ukraine of the citizenship of his adoptive parents as a result of his adoption by foreigners;
  • automatic acquisition by a citizen of Ukraine of another citizenship due to marriage with a foreigner;
  • automatic acquisition by a citizen of Ukraine who has reached the age of majority of another citizenship due to the application of legislation on the citizenship of a foreign state, if such a citizen of Ukraine has not received a document confirming his citizenship of another state.

Among the reasons for forced deprivation of Ukrainian citizenship are also:

  • the use by an adult citizen of Ukraine who has the citizenship of a foreign state on the territory of Ukraine of a foreigner’s passport document, the consequence of which is the creation of threats to national security or the national interests of Ukraine;
  • acquisition by a person of Ukrainian citizenship as a result of submitting false information, forged documents, concealment of any significant fact, in the presence of which a decision could not be made regarding the person to accept Ukrainian citizenship.
  • failure to fulfill the obligation to pass exams on the basics of the Constitution of Ukraine, History of Ukraine and the level of proficiency in the state language;
  • establishing the fact that a person has completed military service under a contract in an aggressor state or an occupier state.

In addition, the basis for termination of citizenship may also be the entry into force of a court conviction against persons convicted in Ukraine for committing a crime against the fundamentals of national security of Ukraineagainst the peace, security of mankind and international law and order, as well as for committing a terrorist actor for the perception that a terrorist act has been committed.

Participation in armed aggression against Ukraine is also considered grounds for termination of Ukrainian citizenship.

However, the provisions of paragraphs 1, 2, 4-6 of this bill do not apply if, as a result, a citizen of Ukraine becomes stateless.

The date of termination of citizenship is the date of publication of the corresponding decree of the President of Ukraine.

Multiple citizenship in Ukraine

Note that multiple citizenship is a citizenship status in which a person is consistently recognized as a citizen of two or more countries under the laws of these countries. However, the Constitution of Ukraine (Article 4) determines that in Ukraine there is single citizenship.

In October 2023, the Ministry of Foreign Affairs stated that they consider it necessary to introduce multiple citizenship in Ukraine. But there must be exceptions regarding the prohibition of any dual citizenship with the aggressor state.

Even before the full-scale invasion of the Russian Federation in Ukraine, the possibility of regulating the issues of multiple citizenship at the legislative level was considered.

In December 2021, President Vladimir Zelensky introduced a bill on multiple citizenship to the Verkhovna Rada, but the document was never considered.

Today Zelensky introduced a bill on multiple citizenship to the Rada.
