In the negotiations of the law proposal, some amendments were made with the joint motions signed by the opposition deputies on some of the articles.
Military sports clubs will be able to participate in sports activities
According to this, “acquiring the establishment and legal personality of sports clubs”, “acquiring and losing the qualification of a sports joint stock company”, “financial provisions”, “penalties to be imposed in case the immovables allocated to the clubs and the support provided are used out of their intended purpose” Without prejudice to the provisions of the law, the regulations in the proposal will not be applied to the sports federations with the founding law.
Military sports clubs that are in the staff and organization of the Ministry of National Defense can be registered according to the offer and participate in sports activities, but other provisions, except for the provisions of the offer regulating participation in sports activities, will not be applied to these clubs.
The regulation that the sports clubs registered by the Ministry will be notified to the Ministry of Interior within 1 month from the date of registration was also removed from the proposal text with a joint proposal.
The management, audit, discipline and other optional board memberships of those convicted of hate and discrimination crimes in sports clubs, sports joint-stock company subsidiaries and affiliates will automatically terminate on the date the court or related board decision about them becomes final.
Merger and asset transfer transactions will be carried out in the inter-seasonal period.
According to the news of AA, in order to leave the determination of the sports club membership conditions to the general provisions and sports club bylaws, “The statutes of sports clubs will not contain provisions that will unlawfully limit membership” The relevant regulation was also removed from the proposal text.
Merger and transfer of assets can be done from the date the season determined by the sports federation ends and is registered until the beginning of the new season.
Arrangements regarding combining resources and forces, cooperation, jointly establishing and using sports center fields and facilities, which are among the founding objectives of the higher organizations, were removed from the proposal text.
The place of dismissed persons will be replaced by substitute members.
In case of dismissal of persons who are prosecuted for crimes within the scope of the Law on the Prevention of the Financing of Terrorism, manufacturing and trading of narcotic or stimulant substances in the Turkish Penal Code, or laundering the assets resulting from crime, their positions will be completed with substitute members. If it cannot be completed in this way, it will be completed by holding an extraordinary general assembly elected by the commission to be appointed by the governorship.
While the obligation to provide all kinds of information, documents and records requested by the officials during the audit, by the sports club and sports joint stock company officials, continues, “fulfillment of the desire to enter all buildings, facilities and their annexes in the use of the club” obligation has been removed from the proposal text.
