New setback to the animal welfare law. The animal protection, rights and welfare regulation, approved in March, required dog insurance to be taken out, a “responsible ownership” course for owners to be carried out and certain animals included in a positive list to be identified as of 29 September, but since the Government is in office, its application is delayed as a specific regulatory development has to be approved.
This has been confirmed by the General Directorate of Animal Rights, dependent on the Ministry of Social Rights and Agenda 2023, in a circular in which it is recognized that the mandatory contracting of civil liability insurance for dogs is postponed until a regulation that develops the standard. Civil liability insurance is a policy that covers the damage that these animals can cause to third parties, whether material, another animal or even a person, and will be mandatory for the more than 9 million dogs that are estimated to exist in Spain, according to the AFAAC association.
The regulations will have to determine the minimum capital with which these animals will have to be covered. According to the association of Spanish insurers, Unespa, dogs are behind the majority of accidents related to pets and cause mainly material damage, with an average cost of 466 euros. However, the Ministry warns that it is common for this type of insurance to be included in home insurance, so the department headed by Sergio Antonio García Torres recommends that dog owners ask their insurance company before carrying out other procedures. .
Despite the fact that the obligation is delayed and that the ministry affirms that some “autonomous and local” regulations already establish the need to have civil liability insurance for dogs, insurers told Efe that in recent months there has been an increase of interest in taking out policies for pets, which rises to 20% in the case of large cities.
