We are talking about powers of attorney issued without the use of special forms of notarial documents on white sheets of paper and certified by a notary.
“The most relevant rule on the issue of crossing the state border is the rule providing for the verification of the validity of powers of attorney set forth without the use of special forms of notarial documents on white sheets of paper and certified by a notary in accordance with the law,” the report says.
The corresponding resolution of the Cabinet of Ministers of Ukraine was adopted on May 9 (came into force on May 23). The document provides for a list of features (prohibitions), according to which notarial acts are performed under martial law and within one month from the date of its termination or cancellation.
Powers of attorney issued after May 23
The Decree provides that powers of attorney certified on white paper issued after May 23 lose their validity.
Powers of attorney received before May 23
Such documents will be checked by border guards by obtaining a certificate confirming or refuting the certification of such a power of attorney by a notary.

If you have such a power of attorney and plan to send your child abroad for rest and recuperation, accompanied by third parties, please note that the indicated forms issued after May 23 are invalid.
Also, forms received before May 23, in case of doubt about their validity, can be checked by border guards by obtaining a certificate of confirmation or refutation of the certification of such a power of attorney by a notary, which in turn provides for a refusal to cross the state border until confirmation is received from a notary.
Departure of children abroad
At the time of the introduction of martial law in Ukraine, departure from Ukraine of children under 16 years of age, accompanied by one of the parents, a woman, grandfather, adult brother, sister, stepmother, stepfather or other persons authorized by one of the parents by a written statement, certified body of guardianship and guardianship, is carried out without a notarized consent of the second parent and in the presence of a passport of a citizen of Ukraine or a birth certificate of a child (in the absence of a passport of a citizen of Ukraine) / documents containing information about the person, on the basis of which the State Border Service will allow crossing the state border.
