New Regulations for Rooftop Solar Power Plants: PLN Business License Required, ESDM Reveals Alasan

Jakarta, CNBC Indonesia The Ministry of Energy and Mineral Resources (ESDM) has officially issued revised regulations regarding the use of rooftop solar power plants (rooftop PLTS). These rules are contained in the Minister of Energy and Mineral Resources’ regulation (Permen) Number 2 of 2024.

Secretary General of the Ministry of Energy and Mineral Resources (ESDM) Dadan Kusdiana said that the installation of PLTS Rooftops must obtain permission from PT PLN (Persero) as the Business License Holder for Providing Electricity for Public Use (IUPTLU). This follows the existence of a development quota system.

According to Dadan, the quota system in the Ministerial Regulation is intended to maintain reliable quality of PLN electricity distribution to PLTS Rooftop customers. This is because one of the characteristics of PLTS Rooftops is that they are intermittent.

“PLN also has limitations in terms of receiving electricity from rooftop PLTS. Right now, rooftop PLTS like this are cloudy. On the one hand, they have to provide channeled electricity. From that side, so that what is called quality at PLN is guaranteed to the community, there is a quota,” said Dadan when met at the Ministry of Energy and Mineral Resources Building, Friday (23/2/2024).

Meanwhile, apart from the quota system, one of the substances revised in this new regulation is the regulation of electricity exports and imports from consumers to PT PLN. In this revision, electricity export and import regulations have been abolished.

In this way, excess electricity from the rooftop PLTS system that enters the network is currently no longer taken into account in the electricity bill of customers who install rooftop PLTS.

“There are no exports and imports, there is no deposit. In the past, you could leave it at PLN and then use it at night. Households use it at night even though the sun is not suitable during the day,” said Dadan.

So, regarding the quota for the construction of PLTS Rooftops, there are several articles. Among them:

Article 7:

(1) IUPTLU holders are required to prepare a quota for the development of Rooftop PLTS Systems for each Electric Power System.

(2) The preparation of the Rooftop PLTS System development quota as intended in paragraph (1) at least considers:

a. direction of national energy policy;

b. plans and realization of electricity supply business plans; And

c. reliability of the Electric Power System in accordance with the provisions in the IUPTLU Holder’s Electric Power System network regulations (grid code).

(3) The Rooftop PLTS System development quota as intended in paragraph (1) is prepared for a period of 5 (five) years which is detailed for each year from January to December.

Article 8:

(1) The Rooftop PLTS System development quota as intended in Article 7 paragraph (1) is proposed to the Director General of Electricity with a copy to the Director General of EBTKE.

(2) The proposed quota for the development of the Rooftop PLTS System as intended in paragraph (1) is accompanied by a technical study document.

(3) The proposed quota for the development of the PLTS Rooftop System as intended in paragraph (1) for 2024 to 2028, shall be submitted no later than 3 (three) months after this Ministerial Regulation is promulgated.

(4) The proposed quota for the development of the PLTS Rooftop System as intended in paragraph (1) for the following year is submitted no later than October before the current year.

(5) The Director General of Electricity shall evaluate the proposed quota for the development of the Rooftop PLTS System as intended in paragraph (3) and paragraph (4).

(6) In carrying out the evaluation as intended in paragraph (5) the Director General of Electricity involves the Director General of EBTKE and may involve related ministries/institutions and/or regional governments.

Article 9:

(1) Based on the evaluation results as intended in Article 8 paragraph (6), the Director General of Electricity shall determine the quota for the development of the Rooftop PLTS System no later than:

a. 1 (one) month after the proposed quota for the development of the Rooftop PLTS System as intended in Article 8 paragraph (3) is submitted completely and correctly; And

b. in December before the current year, after the proposed quota for the development of the Rooftop PLTS System as intended in Article 8 paragraph (4) is submitted.

(2) Determination of the quota for the development of the Rooftop PLTS System as intended in paragraph (1) is submitted to the IUPTLU Holder.

(3) Based on the determination of the quota for the development of the PLTS Rooftop System as intended in paragraph (2), the IUPTLU Holder shall prepare the quota for the development of the PLTS Rooftop System based on clustering.

(4) Clustering as referred to in paragraph (3) is the Electric Power System in the customer service unit of the IUPTLU Holder.

(5) The Rooftop PLTS System development quota based on clustering as intended in paragraph (3) must:

a. reported to the Director General of Electricity and the Director General of EBTKE; and b. published via the IUPTLU Holder’s official website, application and/or social media, no later than 10 (ten) working days after the Rooftop PLTS System development quota is determined.

Article 10:

(1) IUPTLU holders can propose changes to the quota for the development of Rooftop PLTS Systems as intended in Article 9 paragraph (2).

(2) The mechanism and procedures for proposed changes to the Rooftop PLTS System development quota as intended in paragraph (1) are implemented in accordance with the mechanism and procedures for the proposed Rooftop PLTS System development quota as intended in Article 7 to Article 9.

(3) In the event that the IUPTLU Holder does not submit a change to the Rooftop PLTS System development quota as intended in paragraph (1), the amount of the Rooftop PLTS System development quota follows the details of the Rooftop PLTS System development quota that have been determined as intended in Article 9 paragraph (2).
