New Regulations for Domestic Workers: Enhancing Protection and Imposing Penalties

In light of the continuous desire to develop work systems, the Council of Ministers, in its last session chaired by Prince Mohammed bin Salman, affirmed the continuity of work with the list of domestic workers and the like, which was issued by Council Resolution No. (310). This regulation, which is expected to be published soon, mainly aims to enhance protection for domestic workers and spare them any unnecessary burdens or risks that may affect their physical and psychological safety.

Financial violations and penalties in the new regulations

The regulation establishes a set of penalties targeting violating workers. These penalties include financial fines of up to 2,000 riyals, or a total ban from working in the Kingdom, or both. It is worth noting that in the event of repeated violations, the worker must bear the costs of returning to his country.

One of the most prominent obligations of the worker in this regulation is to adhere to the agreed works and to follow the orders of the employer. It also requires the worker to keep family secrets that he discovers during his work and not to disclose them to any other party. The regulations are not limited to regulating the rights of the worker alone, but also contain penalties targeting the violating employer. Penalties include a fine of up to 2,000 riyals, or preventing him from recruiting for a year, or both. In the event of a repeat violation, the penalties escalate to include greater financial fines and a long period of prevention from recruitment.

The regulation urges employers not to assign workers to work outside the scope of the agreement. The employer must also pay the agreed wages on a monthly basis, and provide a daily rest period of no less than 9 hours. The regulations also stipulate that deductions from wages should not exceed half of the wage, and this is done only in certain cases such as the implementation of a judicial ruling or compensation for damages that have been committed.
