The Mllheim building committee confirmed the building application for a new gas station at the Globus hardware store. However, there was criticism of the planned advertising flags.
There will soon be another petrol station in the city of Mllheim: the majority of the building committee of the Mllheim municipal council approved a building application submitted by the operators of the Globus hardware store. There was contradiction in the case of advertising flags and a large price display system that was planned for the roundabout in front of the hardware store.
A few months ago, the Globus hardware store chain acquired the neighboring property behind the Toyota dealership Wei and is planning to build a large filling station there with a car wash, self-service wash bays and service areas. To this end, a building with technical rooms and a roof over the filling station are to be erected. There are also eleven parking spaces. The earthworks have long since started, and according to the administration, there is also an objection from a resident and has yet to be checked, reported Mayor Martin Lffler.
In the course of setting up the petrol station, six pumps with a total of twelve filling options will be installed. Furthermore, five storage tanks for flammable liquids have to be built to supply the dispensing systems. Furthermore, drainage and separation systems and the installation of all safety-relevant technical systems that are prescribed for the operation of filling stations are prescribed.
Advertising facilities are under criticism
The Breisgau-Hochschwarzwald district office monitors this part of the building application and is responsible for issuing an operating permit in accordance with the applicable industrial safety ordinance. Franka Huler, head of the building department, explained this before turning to the area of responsibility of the building committee and the lower building law authority. According to the “Untere Wangen” development plan, a green strip with a width of 2.50 meters and three trees are planned, reported Huler.
The planned roofing of the petrol station exceeds the planned building window by about 1.70 meters, but does not protrude into the green stripe, so the building department, who advocated a corresponding exemption, should not be possible for technical reasons.
Because the development plan provides for the planting of a tree for every four parking spaces, the applicant must plant three more trees. However, this creates a conflict with the planning of the advertising systems as they were submitted in the second building application. Here the desired advertising flags collide with the tree locations. The flags themselves also exceed the maximum height of 9.50 meters, which results from the eaves height of 7.50 meters in accordance with the building plan regulations.
Other advertising systems that are attached to the roof or set up on the property of the gas station seem to conform to the regulations of the development plan according to the assessment of the building department.
The big planned price pylon, which is to be erected at the roundabout on the property of the hardware store near Bundesstrasse 3, is different. There is a separate development plan for the special area, which prohibits the construction of such advertising systems, so that the building committee forbids this price pylon in addition to the flags that are too high.
City councilor Jrgen Nafz (CDU), who was against the establishment of a gas station in this location, was angry. He had already raised an objection to the sale of the property, after the original plan was to locate innovative businesses and create jobs on this commercial site. “Neither is the case, the property was sold for a gas station,” criticized Nafz. In his objection, Nafz mentioned content from a closed session, which earned him a warning from Mayor Martin Lffler. Lffler also indicated that the sale had long been completed and that it was only about the building permit procedure.
City councilor Dora Pfeifer-Suger (ALM / Die Grnen) was concerned about the proximity to the water protection zone. If there is a possible leak, the drinking water could be endangered. Building department head Huler contradicted this and referred to a different flow direction of the groundwater currents. Huler assumes that the district office will demand the necessary safety devices in the course of the operating permit procedure.
