The ban on temporary rental contracts will be introduced anyway, but with a number of exceptions. Last month there was a row in the House of Representatives about the new law. The CDA is now looking for a middle ground and has buried the hatchet with the initiators PvdA and CU.
Since 2016, homes in the private sector can be rented out temporarily. The idea was that this would lead to a greater supply of rental properties. That turned out not to be the case. Moreover, it mainly caused uncertainty for tenants. Offering temporary leases is popular because landlords are allowed to increase rents indefinitely if a new tenant moves in.
The House of Representatives now wants to end temporary leases. A bill from PvdA and ChristenUnie that regulates this seemed to be able to count on enough support in the House of Representatives last month, but the vote was postponed indefinitely. This was because VVD and CDA wanted to change the proposal, which led to a political row with PvdA and CU.
There has been intensive consultation behind the scenes over the past week. PvdA and CU refused to defend the proposal in the Senate if the VVD and CDA amendments were adopted. To prevent this, the CDA came up with a new proposal during an extra debate on the issue on Thursday.
The party wants an exception for homeowners who are going to live together, explained Member of Parliament Inge van Dijk. The new law should make it possible for this group to temporarily rent out their own home in this situation. If cohabitation fails, they can return to their own home. If the cohabitation is successful, they can sell the house. The latter is not yet possible if the house is rented out with a permanent contract.
Although this proposal limits the protection of tenants, initiators Henk Nijboer (PvdA) and Pieter Grinwis (CU) responded positively. “We do understand this amendment (amendment of the law, ed.) and do not find it comparable to the previous amendments. Abuse is not lurking here,” said Nijboer.
VVD proposal undermines the aim of the new law
According to Nijboer and Grinwis, this is the case with the proposal from the VVD, which could therefore also count on the support of the CDA at first. The party wants landlords who rent out their second home to have the right to terminate the lease if they want to sell this home. This therefore goes a lot further than the new proposal by Member of Parliament Van Dijk (CDA).
According to the initiators, this plan “undermines” their bill. Nijboer and Grinwis fear that landlords will have contracts terminated under the guise of a planned sale, while still keeping the house. Now that the CDA no longer supports this amendment, it will not be adopted in the parliamentary votes on Tuesday.
However, an option has been included in the new law to give homeowners the option of dissolving a lease if they want to rent out the house to family members. During the previous parliamentary debate, various parties, such as VVD, CDA and PVV, announced that they are in favor of this. Nijboer and Grinwis have emphatically stated that it must concern first-degree relatives, such as children. A court must also decide whether this interest of the landlord outweighs the interest of the tenant.
There are more exceptions to the new law, for example for students. It must also remain possible to rent out for a short period of time.
