German authorities often only approve the operation of wind turbines with the stipulation that certain shutdown times are observed. Standstill rotor blades are intended to protect bats or birds, for example, and thus avoid a violation of the prohibition of killing under species protection law.
On May 19th, 2021, the Higher Administrative Court of Berlin-Brandenburg decided that these shutdown times were incidental provisions. These can be challenged in isolation by the operator of the system with a lawsuit.
