New Federal Personal Law in UAE | Pravasi | Deshabhimani

Manama > New federal personal law comes into effect in UAE for expatriates. Decisions in important family matters such as marriage, child custody, divorce and inheritance are covered by the Act. The new law will be very beneficial for the expatriates including the Malayalis and the non-Muslim community.

The law provides equality in rights and duties and upholds the equality of men and women. Both men and women will have equal rights in property division, divorce, testimony etc. Divorce is possible without following the provisions of the country’s Islamic law. According to this, if one of the couple requests it, the court can grant divorce at the first sitting. Do not give reasons or file a complaint. The requirement of mediation for divorce was also removed. Women have the right to file for divorce and testify.

Wife will be entitled to get maintenance from her husband. Both mother and father have equal rights over the child till the age of 18 years. The requirement of obtaining the consent of the bride’s father or guardian for the marriage was also removed.
The law which was implemented earlier in the Emirate of Abu Dhabi is being implemented in the UAE with amendments. Those residing in the country can adjudicate personal and family matters according to any law the country approves. The UAE has also allowed these matters to be adjudicated according to the laws of the home country. The new law is for those who are not interested in this.
